1. This is an agreement between you and the Messaging Service related to your use of the Messaging Portal. The agreement consists of the following terms and conditions stated here there of. By your use of the Messaging Portal message delivery system, you are deemed to have agreed to all of the terms during the beta development period.

2. We reserve the right, at our sole discretion, to change, modify or otherwise alter these terms and conditions at any time. Such changes and/or modifications shall become effective immediately upon the posting thereof. Without limiting the foregoing, we may occasionally notify you by email or text about changes to the Site or provide notices of changes by displaying notices or links to notices to you generally on the Site. Please review the terms and conditions periodically. Your continued use of the Site following the posting of changes and/or modifications will constitute your acceptance of the revised terms and conditions.

3. Use of Messaging Services: You are not to use the Messaging Portal for any unlawful or abusive purpose, including but not limited to any use which disrupts customers, damages property, or interferes with the ability to provide service to customers. You agree to comply with all laws while using the Messaging Center and you agree not to transmit any communication that would violate any laws, court order or regulation or would likely be offensive to the recipient. You are responsible for all content you transmit through the Messaging Portal. This service is Internet Explorer 6 compatible only. Users must be a minimum of 16 years of age or have parental permission to use this service.

4. Rules of Conduct: You agree that your use of the Services is subject to all applicable laws and regulations and you are solely responsible for all acts or omissions that occur under your account or password, including, without limitation, the contents of your transmissions through the Services. User agrees not to: Disseminate content intended to harass, abuse, threaten, impersonate any other individual or entity, disseminate obscene, defamatory, indecent, harmful, libelous, unlawful and/or other objectionable material/information. Transmit or upload programs or material that contain viruses,  worms, trojan horses or other harmful  programs. Try to gain unauthorized access to the services, other users' accounts, or computers connected to the services though password mining or other means. Violate any applicable laws or regulations.

5. Privacy. This service will not be liable for any lack of privacy you may experience while using the Messaging Service.

6. Limitation of Liability. UNDER NO CIRCUMSTANCES WILL THE MESSAGING SERVICE OR MESSAGING PORTAL  BE LIABLE TO YOU OR ANY OTHER PERSON FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE OR CONSEQUENTIAL DAMAGES OF ANY CHARACTER THAT ARISE FROM YOU OR ANY USERS USE OF THE MESSAGING CENTER. NO Warranties. THIS SERVICE MAKES NO EXPRESS WARRANTY REGARDING THE SERVICE OR THE MESSAGING SERVICES AND SPECIFICALLY DISCLAIMS ANY IMPLIED WARRANTY, INCLUDING ANY WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

7. Agreement. You acknowledge that these terms and conditions are a material part of the decision to provide the Messaging Service to you.

8. Pricing Plans: £1.50 network TopUp fee applies per 10 credits on Pay-as-you-go basis per TopUp code requested by user. Standard carrier WAP/GPRS/UMTS data charges apply for MMS. Credits are good for 14 days. A standard SMS msg requires 2 credit per number sent, WAP/MMS (photos, ringtones) requires 4 credits per number sent. Users must redeem TopUp code on website for credits to appear. Additional plans are pending during the BETA development period. Please revisit the site where the Messaging Service was provided for periodical updates. This does not guarantee delivery of every message. Message Services will do its best to deliver each requested message but cannot be held responsible for issues beyond our control: network failures/delays, carrier failures/delays, technical failures.
